DataHumm Terms of Service

Please read these Terms carefully before using DataHumm.com (the "Site").

DataHumm may modify these Terms at any time. By using the Site or the DataHumm Services you are accepting the terms and conditions at the time of your use.

You are responsible for any activity that occurs under your user account(s) and shall comply with all applicable laws and regulations in connection with your use of the Data Services, including those related to data privacy (including the GDPR, General Data Protection Regulation).

Services

DataHumm offers data extraction services to our clients. As a DataHumm customer, you acknowledge and agree that your use of the Services is subject to our terms of service which we may change at any time and for any reason. We recommend that you check the terms of service at least once a month to be informed of any changes.

License

DataHumm grants you a non-exclusive, non-transferable, worldwide license to use the Services, solely for business purposes, subject to the Terms of this Agreement.

You may not access DataHumm's Data Mining Platform if you are a direct competitor of DataHumm, except with DataHumm's prior written consent.

You are not authorized to sublicense, sell or transfer the DataHumm Services, except with the prior written consent of DataHumm.

Legal Disclaimer and Warning

Scraping of public websites is in most cases legal. However, we recommend that you consult an attorney to determine the legality of how you plan to use our Services. DataHumm will never knowingly provide an illegal data mining service. DataHumm reserves the right to refuse service to anyone who wishes to use the Services illegally.

DataHumm may immediately suspend the Services if your chosen data mining source, website, or repository contacts us and requests that all mining activity cease. If such an event occurs, DataHumm will not disclose your information without a court order directing it to do so. However, if DataHumm receives a court order requiring the disclosure of your information to a third party, it will comply.

Prohibited uses

The use of any DataHumm Service or product is strictly prohibited in the following cases:

• Extract data that is illegal under the law in any state or country where you reside;

• Extract data from pornographic websites, hate-related websites, websites that promote violence, or drug-related websites;

• Participate in any action or practice that creates a bad image for DataHumm or disparages or devalues the reputation or goodwill of DataHumm.

Violation of these terms may result in immediate termination of the Services without notice and may be subject to state and federal penalties and other legal consequences.

You acknowledge that the Services and Content may include data from publicly accessible websites and may include copyrighted content. In all cases where copyrighted data may be included as part or all of the Content or Services, you agree to comply with all copyright laws covering such data, including (but not limited to) reproduction and resale of said data. In connection with any and all Content and Services provided by DataHumm or performed by DataHumm on its behalf, DataHumm affirms, represents and warrants that it follows and upholds web scrapping industry standards regarding public data and unauthorized access to websites. You agree that, except as otherwise provided in these Terms, DataHumm will not be responsible for any legal liabilities incurred by your use or misuse of data obtained through the Services.

Warranty

Except as otherwise provided in these Terms, DataHumm does not guarantee the reliability, timeliness, quality, suitability, truth, availability, accuracy, or completeness of any Content or Service.
